A MAN attacked his then partner after she was said to have questioned him over a text from another woman, a court heard.

Ricky-Lee Benson had dived at Kelly Shone, thrown her across the bed, grabbed her by the throat and tried to apply pressure. He then smashed her mobile phone against the wall when he thought she was calling the police, Pennine magistrates were told.

The hearing was told the victim had thought the defendant had been unfaithful to her and had been questioning him before the assault last October 22nd.

Benson (28), of Hibson Road, Nelson, admitted assault by beating and damage to the tune of £50. He was given a 12-month community order, with supervision and must pay a £60 victim surcharge, £85 costs and £50 compensation.

Miss Charlotte Crane (prosecuting) said the victim would say there had been previous incidents of domestic violence and Benson had first assaulted her in January last year, five months after their relationship stated. The defendant had been cautioned last October 5th when he had grabbed her by the throat.

Last October 22nd, Ms Shone was at his home when he assaulted her. The defendant was arrested by police and told them he probably did “strangle” her.

Mr Glen Smith, for Benson, said he and Kelly Shone would not get back together again. The solicitor, who told the court Benson had been laid off work, said: “He doesn’t try to justify his actions, but acknowledges his shortcomings where they exist and wants to deal with them.”

A text had come from another female there had been issues about. The defendant, who was not having a relationship with the woman, asked Ms Shone to leave. She wouldn’t, there was an argument and he reacted in the way he did. Mr Smith added: “He is extremely embarrassed about it.”
