Imran Khan (35) caught the attention of police at 11.40pm as his bumper was hanging off. He smelled of drink and blew 86 microgrammes of alcohol in 100 millilitres of breath. The legal limit is 35.

Khan had been banned after being convicted of excess alcohol in January but the disqualification had later been lifted as he is due to appeal the conviction. The appeal hearing is listed for October 11, Burnley Magistrates' Court heard.

In the latest case, the defendant admitted driving with excess alcohol on Halifax Road in Brierfield, on June 24.

District Judge John Maxwell gave Khan an interim ban until after the appeal. He said what happened at the appeal hearing would make a significant difference to sentencing. Khan was given unconditional bail.
