A thief stole a pair of women’s jeans from Matalan in Colne for his wife after she suffered a stroke, Burnley magistrates heard.

The court was told how Frank Henry Dempsey (48) put the £84 haul in a bag, but he was caught and the trousers were recovered.

Dempsey, who was on a conditional discharge for a similar offence, had, said his solicitor, a criminal record going back many years, but it had slowed considerably of late.

The defendant had recently been under stress after his wife had the stroke.

Dempsey, of Napier Street, Nelson, admitted theft from the North Valley store on June 25th.

He was given a 12 month conditional discharge and must pay a £20 victim surcharge.

Mark Williams (defending Dempsey) said: “This is a matter he accepts should never have happened.

“For some reason, he took the jeans without paying and accepts taking more than one pair. He didn’t get very far. He was stopped.”

The solicitor added: “He can only apologise. All the property was recovered and there was nothing sophisticated about it.”
